CONTESTING A WILL OR TRUST
If you are related to someone who has died and you believe the
will was improperly drafted, the decedent was coerced into signing the will or
changing its terms, or you believe the decedent lacked the mental capacity to
make a will, you may want to challenge the will.
DEFENDING A WILL CONTEST
If you are named in a will as beneficiary or executor, and
someone has filed suit to challenge the will or is threatening to do so, you
should hire an attorney immediately.
DISPUTES WITH EXECUTORS OR TRUSTEES
If you are a beneficiary of a will and the executor has not
treated you fairly or is mismanaging the estate, you may need to pursue your legal
rights. Similarly, if you are the beneficiary of a trust, the trustee must
fairly manage the trust for the best interests of the
beneficiaries. Executors and trustees are fiduciaries
